Listed authorities covered by the Scotland specific duties

Below is an alphabetical list of all the public authorities who are covered not only by the general public sector equality duty (PSED), but also by the Scotland specific duties under the Equality Act.

Where public authorities belong to a clearly defined sector, such as licensing boards, this is listed in the second column of the table. This is intended to make it easier to find which authorities in that sector are covered.

Board diversity duty

In 2016, there was an amendment to the PSED specific duties Regulations. This introduced a new duty on some authorities to:

  • publish information on the number of men and women on their board
  • a duty on the Scottish Government to collect information on the protected characteristics of board members of relevant authorities and share that information with those authorities
  • for authorities to publish how they have, and how they intend to, take steps to achieve diversity on their boards.

To date, the Scottish Government have not collected the information required for relevant authorities to use. Relevant authorities who are subject to the duty to publish information about the sex of their board members are indicated in the fourth column of the table.

Scottish Ministers

While the specific duties lie with Scottish Ministers, the term 'Scottish Ministers' includes all ministers and Scottish Government Executive Agencies. Current Scottish Executive Agencies are:

  • Accountant in Bankruptcy

  • Disclosure Scotland

  • Education Scotland

  • Forestry and Land Scotland

  • Scottish Prison Service

  • Scottish Public Pensions Agency

  • Social Security Scotland

  • Student Awards Agency for Scotland

  • Transport Scotland

The reporting schedule for Scottish Ministers and Executive Agencies is included in the table below. 

Reporting schedules

Most listed authorities started their reporting in 2013 and publish every 2 years or 4 years depending on the particular duty. Further authorities have been added by amendment to the regulation, so report on different timescales.

Each public authority's reporting schedule is listed in the third column of the table. The reporting schedules are as follows:

Schedule A

Due every two years from April 2017:

  • report on mainstreaming the equality duty
  • published equality outcomes or report on progress
  • employee information report

Due every two years from April 2017:

  • gender pay gap information (for authorities with 20 or more staff)

Due every four years from April 2017:

  • published statement on equal pay (for authorities with 20 more staff)

If an authority on reporting schedule 'A' has 150 or more staff, all its equal pay statements should report on sex, race and disability.

If it has between 20 and 150 staff, its first equal pay statement should report on sex only. From 2021 onwards, it should report on sex, race and disability.

Schedule B

Due every two years from April 2016:

  • report on mainstreaming the equality duty
  • published equality outcomes or report on progress
  • employee information report.

Due every two years from April 2018:

  • gender pay gap information (for authorities with 20 or more staff)

Due every four years from April 2018:

  • published statement on equal pay

For an authority on reporting schedule 'B', its first equal pay statement should cover sex only. From April 2022 it should report on sex, race and disability every four years.

Schedule C

Due every two years from April 2020:

  • report on mainstreaming the equality duty
  • published equality outcomes or report on progress
  • employee information report.

Due every two years from April 2020:

  • gender pay gap information (for authorities with 20 or more staff)

Due every four years from April 2020:

  • published statement on equal pay

Schedule D

Due every two years from April 2021:

  • report on mainstreaming the equality duty
  • published equality outcomes or report on progress
  • employee information report.

Due every two years from April 2021:

  • gender pay gap information (for authorities with 20 or more staff)

For authorities on reporting schedule 'C' and 'D', the first equal pay statement should cover sex only. From April 2024 it should report on sex, race and disability every four years.
