Coronavirus: suspension on PSED reporting obligations
Due to the Coronavirus outbreak, we have reviewed our approach to enforcing compliance with the PSED specific duty reporting obligations in 2020.
Where possible, we encourage public authorities who can meet these obligations to do so. The requirements of the general duty remain in force and are critically important to ensure that public authorities consider the needs and disadvantages faced by people with different protected characteristics as they respond to Coronavirus.
We’ve written to public authorities who are due to report under the Scottish specific duties in April 2020. The Coronavirus (Scotland) Act 2020 allows public authorities to postpone their reporting if it would disrupt effective action to reduce the spread of Coronavirus. We have advised authorities to continue to do what they can to publish in time to meet existing deadlines, but if this is not possible, to consider releasing a draft and publishing final reports when possible.
We’ve written to public authorities who are due to report in 2021 advising that they will still be required to report by 30 April 2021, unless the Coronavirus (Scotland) Act 2020 is extended. The Scottish specific duties require listed authorities to take reasonable steps to involve people with relevant protected characteristics when setting their equality outcomes. While we understand that the outbreak of the pandemic is likely to limit involvement, they should continue to engage with their equality stakeholders, where possible.
