If performance is managed properly, pregnancy should make very little difference to the way in which performance is addressed.
- An employee who suffers a miscarriage is not entitled to Statutory Maternity Leave or Statutory Maternity Pay. An employer may decide to allow the employee some form of compassionate leave to cover this situation.
- An employee whose baby is stillborn will be entitled to Statutory Maternity Leave and Statutory Maternity Pay if the employee satisfies the relevant eligibility conditions
- If an employee gives birth to a live baby but the baby later dies, the employee will be entitled to Statutory Maternity Leave and Statutory Maternity Pay if the employee satisfies the relevant eligibility conditions.
