This is current law

The forthcoming Equality Act may update this law.

It is well recognised that equal pay for men and women cannot be achieved through legislation alone. Employers are ultimately responsible for ensuring that their pay systems are free from gender bias. We are committed to working with employers to enable them to deliver fair pay systems in accordance with equal pay legislation.

Equal pay audits

Many employers are aware of the benefits this can bring and have taken steps to voluntarily promote and provide equal pay in their workplace. Read more information about carrying out an equal pay audit. To assist employers already doing this and those considering it, we have provided several tools:

These tools are designed to inform employers of the importance and benefits of providing a fair pay system.

Equality impact assessments

The principles and techniques for an equal pay audit are equally applicable to carrying out an equality impact assessment on proposals to change pay policies, especially new grading and pay structures. Read more about equality impact assessments.

Measuring and reporting on the gender pay gap (gender pay metrics)

The Commission has issued new proposals for gender pay reporting in the private and third sectors. We sought input from the business community, trade unions and other stakeholders to develop workable arrangements for private and voluntary sector employers to measure and publish information on the gender pay gaps in their own organisations. This will be promoted on a voluntary basis. Read more about measuring and reporting on the gender pay gap.

Improving your pay practices

We have produced a series of checklists or guidance notes to help employers deal with the more common causes of unequal pay in the workplace. Read the equal pay checklists and the guidance on how to implement equal pay.
